Terms & Conditions – The Imagination Series Voting Promotion

  1. The “Promoter” is Bacardi Global Brands Limited whose office is at 28 Dorset Square, London, England NW1 6QG.
  2. Please read these terms and conditions (“Terms”) carefully. The Terms contain important information. By participating in this promotion (“Promotion”), each participant declares and agrees to be bound by the Terms.
  3. Entry is free and no purchase is necessary but you will need internet access (and a Facebook account).
  4. The Promotion is only open to participants resident in certain countries and provided that access to and participation in this type of activity in those countries is legitimate and compliant with all applicable local laws, regulations and guidelines without the need for local administrative notifications, registrations or authorisations. By taking part in the Promotion you warrant that your participation is compliant with applicable laws, regulations and guidelines in your country of residence. Please note that residents of Belgium and Canada will be subject to an additional entry step (and residents of Quebec will be unable to enter the Promotion at all) and residents of Australia and Italy will be able to vote but will not be eligible to win a prize.
  5. The Promoter reserves the right to further investigate the eligibility of participants and exclude any entries by participants from countries where applicable laws, regulations or guidelines do not allow participation or make participation subject to local administrative notifications, registrations or authorisations. Proof of age and identity and eligibility may also be required. All participants must be aged 21 or over and also above the minimum age for purchasing and consuming alcoholic beverages (“Legal Age”) in their country of residence. Where an individual’s country of residence has multiple states, districts or zones with different Legal Ages, the highest Legal Age across the entire country shall apply to all that country’s participants.
  6. The following may not enter or win a prize: (a) employees of Promoter or its agents and their first and second degree family members, as well as (b) anyone else who is directly or indirectly professionally connected with the Promotion or the Promoter and their family members.
  7. Entry instructions form part of these Terms. Entries submitted with incomplete information, or found to contain invalid information, shall be deemed invalid entries.
  8. The Promotion can be entered by going to www.imaginationseries.com/vote and voting for your favourite film idea from 10am GMT on Thursday 24 October 2013 (“Start Date”) to 11:59:59pm GMT on Thursday 14 November 2013 (“Closing Date”) (being the “Promotion Period”).
  9. To enter the Promotion you must:
    a) go to www.imaginationseries.com/vote whilst signed into your Facebook account;

    b) click on the voting link for the film idea you want to vote on (if the film idea you vote on wins, then your entry will be entered into the pool for the prize);

    c) allow the app to access personal data details from your Facebook account; and

    d) be resident in one of the countries listed in section 10; By clicking to vote at paragraph 9(b) above, you are confirming that you have read, understood and agree to be bound by these Terms. If you do not provide complete and correct information, the entry will be considered incomplete and therefore invalid.
  10. Countries and Special territories
    • The Promotion is open to residents of the following countries: Austria, Germany, Greece, the Netherlands, Japan, Portugal, South Korea, Spain, United Kingdom and USA.

    • Belgium and Canada: the Promotion is also open to residents of residents of Belgium and Canada but they will need to answer a skill-based question correctly (residents of other countries will not need to answer the question); residents of Quebec are not admitted to participate to the Promotion.

    • Italy and Australia: the Promotion is not open to residents of Italy and of Australia but even if they are not eligible for the prize nor for any reward whatsoever, they can express their preference for a film idea by clicking on the link of the one they want to vote.
  11. Entry is limited to one vote per person per day.
  12. The Promoter does not accept responsibility for any network, computer hardware or software failure of any kind which may restrict or delay the sending or receipt of your entry. The Promoter accepts no responsibility for entries lost, damaged, delayed or unreadable, including loss of entries through technical fault or transmission delays.
  13. The winner is responsible for ensuring he/she is able to accept the prize as set out below (including without limitation in relation the dates and location) and in accordance with these Terms. In the event he/she is unable to do so then the Promoter reserves the right to reward the prize to another eligible entrant (and so on until a winner who is eligible and able to accept the prize is found).
  14. This Promotion is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering, you acknowledge that Facebook bears no responsibility for this Promotion and, to the maximum extent permitted by law, you release Facebook from any liability whatsoever in connection with this Promotion. You understand that the information you provide is provided to the Promoter (and its affiliates, associates and agents where applicable) and not to Facebook.
  15. Prize (one prize available in total): The prize consists of a 3-night trip to New York City, New York for two people (winner and their guest) during (or within two days either side of) the Tribeca Film Festival 2014 (which takes place from 16 to 27 April 2014). The prize includes: economy return flights to New York City from winner’s place of residence, airport transfers, and 3 nights’ hotel accommodation (based on two people sharing a standard twin or double room), two] Harrison Package tickets to the Tribeca Film Festival 2014, New York City, and $500 USD spending money (in total). If winner resides within 200 miles of New York City, only ground transportation will be provided. No cash or other compensation will be awarded for the difference in value between air transportation and ground transportation. Winner and his or her guest must travel from winner’s place of residence. The prize will also include entry to the Bombay Sapphire Imagination Series premiere (“Premiere”), which is not part of the Tribeca Film Festival but will be held in New York City on a date to be confirmed in due course between 14 and 29 April 2014. At the Premiere, the winner and their guest will be able to attend a “meet and greet” with Geoffrey Fletcher. If the winner decides not to travel on dates that include the date of Premiere (as notified to them as soon as the date for the Premiere is confirmed), there will be no additional or alternative benefit. Whilst all reasonable endeavours will be used to ensure Geoffrey Fletcher is present for the “meet and greet”, the Promoter accepts no liability if, due to unforeseen circumstances, he is unable to attend. The Promoter and its affiliates will under no circumstances whatsoever be liable for (a) any delays or changes which are beyond their reasonable control; (b) any disruptions, cancellations, diversions, substitutions, or the unavailability of the prize due to local public holidays, strikes or other force majeure circumstances affecting availability or enjoyment of the prize (for example if the Tribeca Film Festival 2014 is cancelled), or (c) any act or omission whatsoever by any form of transportation and / or accommodation included in the prize. Air carrier, hotel and other prize elements will be selected exclusively by Promoter. Winner and /or guest must provide the hotel with a major credit card issued in one of their names to cover hotel room security and incidental expenses. The winner and one guest (who must also be over the Legal Age in their country of residence) must be available for a trip to New York between 14 and 29 April 2013, including the necessary travel time. These dates are fixed and cannot be changed by winner. Winner may be required to take part in interviews and/or other media activity at the Tribeca Film Festival and/or the Premiere (if applicable) and in connection with the Promotion and so all entrants must be able to speak and understand English to a reasonable standard. The winner and his/her guest must have valid travel documentation such as a passport (minimum validity six months from outbound travel date) and visa as applicable and comply with any customs, immigration or other regulatory requirements for full and unlimited attendance. The prize does not guarantee issuing of visas to the winner or the winner’s guest. The winner and his/her guest are responsible for ensuring they have valid and appropriate travel insurance and releases the Promoter from any liability or claim for losses and/or damages of any nature. Third party terms and conditions apply to parts of the prize where applicable. The total maximum approximate retail value of the prize is $4500 if a resident of the USA or of Canada is a winner (on account, among other reasons, of only domestic flight tickets being needed). The prize description is illustrative and not definitive and the total retail prize value stated herein is only an indicative value. Actual value of prize may vary based on point of departure and dates of travel. Any difference between actual value and value stated herein will not be payable to the winner. PLEASE NOTE: All other costs and expenses, including food and drink, entertainment, hotel extras, travel insurance, and other additional costs that arise are NOT included in the prize are the responsibility of the winner and the winner’s guest. It is the responsibility of the winner and of the winner’s guest to be in good health and appropriately fit for travel and by starting their trip to New York from the winner’s domicile they waive any claim they may have against the Promoter for any safety or health issue or problem they may have during the travel and attendance at Tribeca Film Festival or the Premiere (if applicable). If a winner is unable to take part due to safety, health reasons or other reasons, or due to a failure to comply with these Terms then the Promoter reserves the right to award the prize to an alternative winner also drawn from all eligible entries to this effect and award the prize to such alternative winner (and so on until a winner who is eligible and able to accept the prize is found). There is no cash or other alternative to the prize stated and the prize is not transferable or changeable and no part or parts of the prize may be substituted for other benefits, items or additions. However, the Promoter reserves the right to substitute a prize of equal or greater value in the event of circumstances beyond their control requiring this.
  16. As a result of acceptance and use of the prize, winners may have to pay federal, state, or other taxes, levies or duties on the value of the prize, according to the laws of their country of residence or domicile (including income tax). In such cases, payment of any applicable taxes, levies or duties on the winners shall be the winners’ sole responsibility and, for the avoidance of doubt, shall not be deducted at source by the Promoter.
  17. The Draw: After the Closing Date and after the winning film idea from the Imagination Series competition has been announced, one winner will be drawn by the judge(s) at random from all complete and eligible entries received from participants who voted for the said winning film idea. The judge(s) will also draw in the same manner other participants for the event the potential winner does not communicate his/her acceptance of the prize as follows. The potential winner will be notified within 14 days of the Closing Date. All reasonable endeavours will be made to contact the potential winner during this time using the contact details provided at entry. If the potential winner cannot be contacted within 14 days or no acknowledgement of being contacted is received within 14 days, the award to that winner will be withdrawn and the Promoter reserves the right to award the prize to the first alternative winner drawn for this event (and so on until a winner who is eligible and able to accept the prize is found). The Promoter will not be responsible for any inability of any winner to take up the prize.
  18. Publicity Release Terms: By entering this Promotion you agree that if you are the prize winner you shall grant the Promoter the free use of your name, country of residence, photographs, video and voice (“Image”) for publicity and news purposes in any media during and after this and future promotions by the Promoter or any associated, affiliated or subsidiary company of the Promoter, except where prohibited by law. In the event that you are the winner, your acceptance of the prize shall be deemed to be a confirmation of your agreement for the Promoter to use your Image and the Image of your guest, and you and your guest shall sign any further document reasonably required by the Promoter to this effect, except where prohibited by law.
  19. Affidavit of Eligibility/Liability & Publicity Release: The Promoter reserves to require the potential winner to sign and return an Affidavit of Eligibility, Liability Release and/or Publicity Release (where legal) (collectively the “Release Forms”) within five (5) days of notification. In the event of non-compliance with these requirements (including execution of the Release Forms) or if the documentation is returned as undeliverable, the prize will be forfeited and awarded to an alternate winner if feasible. The Promoter further reserves to require the guest of the potential winner to complete, execute and return a Winner Guest Liability Release, and where lawful, a Winner Guest Publicity Release (collectively, the “Winner Guest Release Forms”) prior to issuance of travel documents. Failure to return the Winner Guest Release Form at the same time as the potential winner’s Release Forms may prevent the Winner Guest from participating in the trip. If the potential winner is found not to be eligible or not in compliance with these Terms, the potential winner will be disqualified and an alternate potential winner may be selected in accordance herewith.
  20. The Promoter’s decision is final and no correspondence will be entered into.
  21. No third party entries, bulk entries or entries submitted by agents will be accepted.
  22. If the Promoter has grounds to suspect any entrant or third party of cheating, deception or fraudulent or unsportsmanlike conduct of any kind (including, without limitation, manipulating the promotion, choice of prize winner(s) or any entry) the Promoter reserves the right (in its sole discretion) to: disqualify any participant, entry or person it reasonably believes to be responsible for, or associated with, such activity; and/or to declare void the notification of any winner, and/or to withhold the prize.
  23. The Promoter reserves the right at any time to cancel, modify or supersede the Promotion at its sole discretion and/or to amend these Terms at any time.
  24. Promoter, its affiliates, subsidiaries, distributors, licensees, advertising, promotion and media agencies and the directors, officers, employees, representatives and agents of each, assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, the selection and announcement of the prize winner, or the distribution of the prize, the acceptance/possession and/or use/misuse of any part of the prize and/or any injury or damage to entrant's or third person's property related to or resulting from any part of any prize or any part of the Promotion including, without limitation, any travel related thereto and attendance at the Tribeca Film Festival and the Premiere. Each entrant in this Promotion, including, without limitation, the prize winner, hereby releases and agrees to hold harmless Promoter, its parent, affiliates, subsidiaries, distributors, licensees, advertising, promotion and media agencies, and the directors, officers, employees, representatives and agents of each from any and all liability for any injuries, loss or damage of any kind to person, including death, and property, arising in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of the prize or any portion thereof, participation in this Promotion in any activity related to this Promotion, without limitation, any travel related thereto and attendance at any events and/or activities related thereto.
  25. If for any reason any aspect of the Promotion does not function correctly, whether by means of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter that corrupts or affects the administration, integrity or fairness of the Promotion, then the Promoter may at its sole discretion cancel, modify or suspend the Promotion and/or invalidate affected entries.
  26. By entering into the Promotion, you agree that your personal data may be collected, stored, processed and used for the purposes of administering this Promotion. Please note that your personal data may be transferred to and/or stored outside the European Economic Area.
  27. These Terms are drafted in English and may be available in other languages. In the event of any discrepancies between versions, the English version shall prevail.

  29. The laws of England and Wales apply to these Terms and any dispute arising out of or in connection with the Promotion and the prize shall be subject to the exclusive jurisdiction of the English courts. If any provision of these Terms is held invalid by any law, rule, order or regulation of any government, or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.
  30. IN NO EVENT WILL PROMOTER, ITS PARENT, AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, DISTRIBUTORS, LICENSEES, ADVERTISING, PROMOTION AND MEDIA AGENCIES, AND EACH OF THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE PROMOTION, THE PRIZE, INCLUDING, WITHOUT LIMITATION, ANY TRAVEL RELATED THERETO AND ATTENDANCE AT THE TRIBECA FILM FESTIVAL AND THE PREMIERE, OR THE USE OR MISUSE OF ANY ITEM FROM THE PROMOTION. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE IMITATIONS OR EXCLUSIONS.
  31. THE PROMOTION AND PRIZE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT.
  32. In the event of a dispute as to the identity of the winner based on a Facebook account and/or e-mail account, the winning entry will be deemed to have been made by the authorized Facebook account holder submitted at time of entry. "Authorized account holder" is defined as the natural person who is assigned to the Facebook by Facebook.

Terms and Conditions

UPDATE: all entrants please note that with immediate effect from today (1 August 2013) the deadline for entry into this Competition has been extended by two weeks.

  1. There are some words used in these terms and conditions that are capitalised.  Where the following capitalised words are used they shall have the following meaning:
    1. Competition: means this Bombay Sapphire Imagination Series film competition to be held during 2013, opening for entries on 29th April 2013.
    2. Competition Partners: means any companies including but not limited to Bacardi Global Brands Limited and its group companies, TFF (as defined below), or any others who are acting on their behalf in any aspect of this Competition.  For clarity, neither Tribeca Film Festival NYC, LLC, nor its parent, subsidiaries and/or affiliates, nor any of their respective officers, directors and/or employees (individually and collectively, “TFF”) may in any event be responsible for the collection, submission or processing of entries, the administration of the Competition or the selection of any winner(s).
    3. Film: If you are selected as a winner then your winning submission will be made into a short film of approximately five minutes in length. See below for further details.
    4. Organiser: means Bacardi Global Brands Limited who is also referred to throughout these terms as “Bombay Sapphire”.
  2. These terms and conditions apply to all those entering the Competition, except residents of the USA and Canada.  Entrants from the USA and Canada must view the following terms before entering, which shall apply to their entry.  Click here for the USA and Canada terms.
  3. This Competition is open to anyone aged 21 years or over at the time of entry and who have registered their details at www.imaginationseries.com or www.bombaysapphire.com or other platforms made available from time to time by the Organiser at their discretion (the “Websites”).  The Organiser reserves the right, in its sole discretion, to add additional websites/applications/platforms on which entrants can submit Entries.  This Competition is only open to participants resident in countries where access to and participation in this type of activity is legitimate and compliant with all applicable local laws, regulations and guidelines without the need for local administrative notifications, registrations or authorisations.  By taking part in the Competition you warrant that your participation is compliant with applicable laws, regulations and guidelines in your country of residence.  The Organiser reserves the right to further investigate the eligibility of participants after receiving their Entry and to exclude any Entries by participants from countries where applicable laws, regulations or guidelines do not allow participation or make participation subject to local administrative notifications, registrations or authorisations. Proof of age and identity and eligibility may also be required.
  4. This Competition is free of charge to enter and no purchase is necessary in order to take part.
  5. Employees (or immediate family members of employees – being spouse, parents, siblings and children) of any group company of the Organiser or Competition Partners, their agencies and any individuals or companies associated with the Competition and all affiliates of all such companies may not enter this Competition.
  6. Entrants will be deemed to have accepted these terms and conditions and agree to be bound by them when entering this Competition. You enter the Competition each time you upload or submit any material on the Websites or if you attempt to do so, however entry is limited to one Entry per person.
  7. This Competition is open for entries on 29th April 2013 from around 05.00pm GMT.
  8. Closing Date: All entries must be received in accordance with these terms and conditions by 11.59pm (GMT) on 18 August 2013.
  9. To take part in and enter this Competition you must visit one of the Websites, register as instructed and submit your entry in line with these terms and conditions and in the formats prescribed below by the Organiser under the heading ‘Entry Guidelines’ (the “Entry”). The Entry Guidelines form part of these terms and conditions.
  10. The Organiser will not take responsibility for any loss or damage to any Entry.
  11. It is a condition of entry and participation that your Entry and any and all content contained within the Entry is your own original work and that it has not been and shall not be made available or published to any third party other than the Organiser prior to submission of your Entry, including without limitation via posting on YouTube, Facebook and / or any other place on the worldwide web.
  12. All entrants warrant that their Entry does not infringe any applicable laws.
  13. By entering this Competition, you irrevocably grant to the Organiser, its agents, licensees, selected sub-licensees, affiliates and assigns the unconditional and perpetual exclusive (or, in the case in which an exclusive license cannot be effectively granted electronically by you in your territory, non-exclusive) right and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Entry as-is or as-edited (with or without using your name) in any media throughout the world whether now known or hereafter invented for any purpose, without limitation, and without additional review, compensation, remuneration, or approval from you or any other party (“permitted purposes”).
  14. In the event that you are selected as a winner and / or your Entry is made into a Film, it is a condition of entry that you will enter into further documentation with the Organiser or its nominated third party as follows: (a) a declaration of eligibility and release and (b) an agreement assigning all intellectual property rights in the Entry and in any derivative works, such as the Film that is made out of such Entry, to the Organiser or its nominated third party. If you are selected as a winner and fail to sign and return the documents outlined in this paragraph 14 within 7 days of the date the documents are emailed to you, then you may forfeit the prize and an alternate winner may be selected in your place according to the judging criteria described below.
  15. Upon submission of your Entry you agree to grant irrevocable royalty-free exclusive rights to the Organiser and its affiliates to exploit the Film worldwide in all media in perpetuity including but not limited to on Bombay Sapphire’s website, any other online platform or other platform used by Bombay Sapphire and in cinemas, TV, IPTV, music content and Mobile.  The rights granted by you under this paragraph to Bombay Sapphire shall be on an exclusive basis, except in the case in which an exclusive license cannot be effectively granted electronically by you in your country of residence, when the rights shall be non-exclusive.    
  16. By entering this Competition you warrant and undertake as follows:
    1. you own all intellectual property rights in your Entry (including but not limited to all ideas, materials and text submitted as part of your entering this Competition) and all other rights, or, if any part of your Entry has been created or contributed to by a third party (in whole or in part), you have obtained the consent of that third party to submitting your Entry and he/she consents to the Entry being used in accordance with these terms and conditions;
    2. you have acquired all rights and clearances necessary for the granting of rights to Bombay Sapphire outlined in these terms and conditions;
    3. your Entry is your own original work which does not infringe any third party rights and that nothing in the Entry is libellous or defamatory or threatening;
    4. you have obtained all relevant rights and written permission from any individuals featured in the Entry, and your Entry does not feature anyone under the age of 25; and
    5.  you accept these terms and conditions and the Organiser’s decisions regarding the Competition.
    6. For clarity, you have no right to use any TFF trademark(s), name, likeness, image and/or other intellectual property in any way including by way of example in your Entry or otherwise in connection with the Competition.
  17. The Organiser reserves the right to pass on any Entry (or part of any Entry) which cause it concern to the relevant authorities.
  18. All entrants hereby waive and agree, to the extent permissible by law, not to assert (and warrant that all individuals featured have waived and agreed not to assert) any moral rights or equivalent rights throughout the world in and in connection with the Entry.
  19. All entrants agree to indemnify and keep indemnified Bombay Sapphire and its Competition Partners against any loss or damage occurring out of any breach of any third party rights and / or these terms and conditions by the entrant in relation to this Competition.
  20. All entrants agree to do such other things and execute such other documents as are reasonably requested of them by the Organiser in order to allow the Organiser to use their Entry for the permitted purposes.
  21. Each individual entrant can submit up to a maximum of one Entry.  If you attempt to enter more than one Entry only your first Entry will be counted and any subsequent Entries will not count and will be disqualified. 
  22. The Organiser does not accept responsibility for technical, network, computer, programme, hardware or software malfunctions or failures of any kind, which may affect, restrict or delay the sending or receipt or processing of your Entry.
  23. Entries must not be sent in through agents or third parties. Incomplete or illegible Entries, and Entries which do not satisfy the requirements of these terms and conditions, will be disqualified and will not be counted.
  24. In the event of a dispute as to the owner of an Entry, the authorised account holder of the e-mail address used to enter will be deemed to be the owner.
  25. All complete, correct and eligible Entries across all countries received before the Closing Date will be considered for short-listing by a panel which is likely to be made up of Geoffrey Fletcher, an independent judge or judges, one or more of which may be nominated by TFF and other representatives selected by the Organiser.  In the event that the Organiser receives over fifty Entries, a total of fifty Entries will be shortlisted for consideration by a panel of judges (which shall include Geoffrey Fletcher and at least one independent judge).  If your Entry is short-listed for submission to the judging panel you will be informed by email on or around 16th September 2013. 
  26. Winners will be selected by using two (2) different methods.  Four (4) winners will be selected by the judges as stated in paragraph 27below.  A further one (1) winner will be selected by means of an online public vote as stated in paragraph 28below.
  27. Four Judge Selected Winners: A total of four (4) winners will be selected by the panel of judge(s) from all short-listed Entries (the “First Four Winners”). There may not be a winner in every country.  The First Four Winners will be the four (4) Entries which, in the opinion and sole discretion of the panel of judges achieve the highest score in demonstrating the greatest degree of imagination and originality (the “Judging Criteria”) in their interpretation of the script written by Geoffrey Fletcher for the purposes of this Competition and published on the Websites. The First Four Winners will be notified by email or telephone using the details they provided, by 13th October 2013. In the event of a draw / tie, the Judges will select winners based on which tied Entry scored highest on Imagination.
  28. One Winner – Public Vote on Shortlist: Once the First Four Winners have been selected, the panel of judges will select a further five (5) Entries from the remaining short-listed Entries to be voted on by the public in accordance with these terms and conditions.
    1. The five (5) Entries shortlisted for the public vote (the “Five Nominated Entries”) will be those which, in the opinion and sole discretion of the panel of judges demonstrate the greatest degree of imagination and originality in their interpretation of the script written by Geoffrey Fletcher for the purposes of this Competition and published on the Websites (second only to the First Four Winners).
    2. The Five Nominated Entries will be announced on or around the same time as the First Four Winners, so no later than 13th October 2013.
    3. The Organiser or their third party representative will create promotional materials from and of the Five Nominated Entries (such as a mood board or treatment summation) (the “Promotion Materials”). The Promotion Materials will be made available through platform(s) from time to time as decided by the Organiser (such platforms may include social media sites, Apps and websites), for individuals to read and view and people will be able to vote for their favourite based on the Judging Criteria in line with these terms and conditions by following the appropriate instructions as set out on the appropriate voting platform (a “Vote”).  Please visit the Websites for detail of where and how Voting will happen once the Five Nominated Entries are made public.  Voting will be open from 14th October 2013 at 12.00 noon GMT and will close on 3rd November 2013 at 11:59pm GMT  (the “Voting Period”). 
    4. One (1) winner will be selected from the Five Nominated Entries, that winner being the Entry from the Five Nominated Entries which, in the Organiser’s sole discretion, has (fairly and properly) gained the most Votes at the end of the Voting Period.  The one (1) winner will be announced by 29 November 2013.  In the event of a draw / tie in the Voting, the winner from the tied Entries will be the Entry with the highest score from the Judges.
    5. All entrants and other third parties may only submit one Vote per day for any one of the Five Nominated Entries and each person may only use one email address to vote, regardless of the number of Websites or platforms on which voting is made available.
    6. If the Organiser has grounds to suspect any entrant, winner or third party of cheating, deception or fraudulent or unsportsman-like conduct of any kind (including, without limitation, manipulating the promotion, choice of prize winner(s), the Voting or total Votes or any entry) the Organiser reserves the right (in its sole discretion) to disqualify any entrant, entry, winner or person it reasonably believes to be responsible for, or associated with, such activity.  The Organiser may at its sole discretion disqualify any Entry where the Vote has been given as a result of or affected by any of the following, or for any of the following behaviour, all of which is not permitted within the Competition:
      1. any Vote or voting for an Entry which results from invalid impressions or clicks generated by any person, robot, bot, automated program or similar device, including clicks or impressions originating from an entrant’s IP address or computers under an entrant’s control in breach of these terms or conditions or solicited by payment of money (including but not limited to paying for Votes), false representation or requests for users to submit a Vote;
      2. a user or entrant giving more than one Vote per day, including by way of deletion of cookies;
      3. attempting to obtain votes by any fraudulent or inappropriate means, including, without limitation, by: (i) circumventing (or encouraging others to circumvent) the vote limits; (ii) using any automated system to vote; or (iii) offering any inducements to others in exchange for votes; or (iv) using proxy voting schemes in which anyone other than the actual person submits the vote; or
      4. a breach of these terms and conditions.
    7. The Organiser, in its sole discretion, reserves the right to reject any Votes that the Organiser has reason to believe were obtained through cheating, fraudulent, or unsportsman-like conduct or inappropriate means or otherwise in breach of these terms and conditions.   
    8. The Organiser reserves the right (but shall not be obliged) to investigate, at its own discretion, any activity that may violate these terms and conditions, including but not limited to any use of a software application to access Entries or any engagement in any activity prohibited by these terms and conditions.
  29. All winners will behave in an appropriate and professional manner as befitting their potential representation of the Organiser and the Bombay Sapphire brand.
  30. Any inappropriate, illegal or immoral behaviour on the part of a winner will result in immediate exclusion from the Competition and the Prize.
  31. This Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook.  By entering, you acknowledge that Facebook bears no responsibility for this Competition and, to the maximum extent permitted by law, you release Facebook from any liability whatsoever in connection with this Competition.  You understand that the information you provide is provided to the Organiser (and its affiliates, associates and agents where applicable) and not to Facebook.
  32. Prize: The prize for each winner includes the following:
    1. If you are selected as a winner then your winning Entry will be made into a short film of approximately five minutes in length.  The five winning treatments will be produced by a company appointed by the Organiser in its sole discretion.
    2. For the purposes of clarity, the Organiser will have ultimate editorial, production and creative control in the Film and the Organiser is (at its discretion) able to control the Film’s content including but not limited to ensuring that it is in line with relevant laws and regulations.
    3. Winners will receive one trip for one person (the winner) to attend a pre-production meeting relating to the Film and one day of the Film shoot (both on the same one trip).   This one trip will be for a minimum of two days and may be more if decided at the discretion of the Organiser and notified to you in advance.  This one trip may be within the country from which you entered the Competition or may involve travel to another country, which shall be decided at the sole discretion of the Organiser and communicated to you as soon as reasonably practical.  The one trip will include round-trip transportation (as determined by the Organiser in its sole discretion), including ground transportation to/from hotel and airport (to the extent flights are thought necessary by the Organiser)/meetings at locations designated by the Organiser, three meals/ per day (at locations determined  by the Organiser) and single-occupancy hotel accommodation for each night of the trip, which the Organiser expects will involve at least two nights (as determined by the Organiser). This one trip will include one x return flight from the winner’s country of residence to the destination city to the extent flights are deemed necessary by the Organiser (at their sole discretion) based upon the final destination of the trip.
    4. Each winner and a guest (who must be of legal drinking age in their country of residence and at least 21 years old) will also receive one round trip to New York, USA where they will attend a premiere viewing of the winning Film.  This trip includes a total of two x return flights to New York from the winner’s country of residence, double-occupancy hotel accommodation (either twin or double room) for three nights in New York, attendance at the premier event for the winning Film and VIP tickets to that event, ground transportation to/from hotel and airport and a total of $600 spending money for use whilst in New York.  The winner’s guest must sign and return a liability and publicity release prior to issuance of travel documents and before being able to take up the prize.  Once travel documents are issued, travel arrangements cannot be changed, except by the Organiser.
    5. The Organiser is under no obligation to distribute the Film but may do so if it chooses, either itself or via a third party distributor and the Organiser is under no obligation to incorporate any of your comments into the Film.
  33. Travel dates: Due to the nature of the prize and its connection to production of the winning Films, winners will be required to be flexible as to when they travel as part of the prize.  Shortly after they have been informed that they are a Winner, the Organiser will consult with the Winners as to the dates they are available to take up the travel element of their prize.  It is likely that Winners will need to travel between November 2013 and March 2014 for the production element of the prize and that the screening for the Film will take place around April 2014.  Whilst the Organiser will use reasonable endeavours to ensure Winners can travel in line with the production timings and screening for their Winning Film the Organiser cannot guarantee this and ultimate discretion as to dates of travel lies absolutely with the Organiser.
  34. The prize does not include travel insurance, for which each winner will be responsible for each trip.  All other expenses not specified herein are the sole responsibility of each Winner.  Any prize details not specified in these terms and conditions will be determined by the Organiser.  Any applicable taxes and levies on all Prizes are solely the responsibility of each Winner.  Each Winner is solely responsible for obtaining any valid passports with no impediment on entering the destination country and any visas or vaccinations required for travel or enjoyment of the Prize and no assistance will be given by the Organiser.
  35. Air carriers, class of travel, hotel, and ground transportation will be selected exclusively by the Organiser. Travel and accommodations are subject to availability and certain restrictions; blackout dates may apply when travel will not be permitted.  Winners must provide the relevant hotel with a credit card issued in their name to cover room security and incidental expenses.  The Organiser assumes no responsibility for cancelled, delayed, suspended or rescheduled travel or events (including airline flights) beyond its control.
  36. The Organiser reserves the right to substitute the prizes (or any part of them) for a prize or prizes of equivalent or greater monetary value if this is necessary for reasons beyond its control.  There is no cash alternative to the prizes (or any part of them) and unless agreed otherwise in writing the prizes are non-refundable and non-transferable.
  37. Third party terms and conditions apply to parts of the prize where applicable.
  38. The Organiser reserves the right to amend these terms and conditions at any time.
  39. If any winner is not able, for any reason, to accept a prize, or cannot be contacted within 7 days of the winners being decided, the Organiser reserves the right to award the prize to another entrant.
  40. The judges’ and Organiser’s decisions shall be final and binding in all respects on all entrants. No correspondence will be entered into and legal processes are excluded. Entries that do not comply in full with these terms and conditions and Entries that, in the Organiser’s sole discretion are in bad taste, may be disqualified at the Organiser’s discretion.  If any Entry is disqualified during the Voting Period the Organiser reserves the right to reset the votes associated with such Entries to zero or any other number, in its sole discretion.
  41. Details of prize winners’ names and country will be available for one month after the close of the Competition by writing to the Organiser at the address set out below and stating the name and Closing Date of the Competition.
  42. Winner(s) agree to allow the Organiser to use their name, likeness, appearance, voice and biographical information for advertising and publicity purposes without remuneration. The winners will take part in reasonable publicity and PR activity at Organiser’s request.

  44. If you have opted in, the Organiser and its business partners may also use the details you give us to contact you for marketing purposes by email and/or SMS.
  45. This Competition, and any dispute or claim arising out of or in connection with it, shall be governed by and construed in accordance with English law. You irrevocably agree that the courts of England shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with this Competition.

  46. Entry Guidelines

  47. If your Entry does not follow these Entry Guidelines then it may not count and it may be disqualified at the sole discretion of the Organiser.
  48. Bombay Sapphire shall publish a script written by Geoffrey Fletcher on the Websites.  If you want to enter, you must submit a written treatment of that script.
  49. Your Entry can be in any language you wish, but please note that the Organiser will translate your Entry into English for the purposes of judging and if applicable for its own promotional purposes and use.  If you are selected as a winner, then your Film will be made in the native language used in your Entry unless otherwise agreed with the Organiser or stated in your treatment. 
  50. Entries must be submitted in the submission formats as specified here and on the Website:
    1. Written treatments must be no longer then 500 words.
    2. Treatments for films which would be over 5 minutes in length may be disqualified at the sole discretion of the Organiser. 
    3. Entrants are NOT allowed to submit supporting materials such as videos, images or photographs and any entrants that submit supporting materials may be disqualified at the sole discretion of the Organiser.
  51. Each time you submit content of any nature (including but not limited to the treatment) as part of your Entry, you must tick the relevant box shown on the relevant Website to confirm that you either own the rights in the content or have acquired the clearance needed to comply with your obligations under these terms and conditions.
  52. Your Entry, including but not limited to the treatment entered must:
    1. comply with all applicable laws and these terms and conditions;
    2. be accurate and not misleading;
    3. adhere to the Organiser’s social responsibility guidelines which can be seen here and
    4. comply with any applicable industry codes on the responsible marketing of alcohol in the country in which you reside.
  53. Your Entry, including but not limited to the treatment entered must NOT:
    1. Encourage, condone, promote or glamorize under age, excessive or irresponsible consumption of alcoholic beverages or drink driving or any behaviour considered antisocial, illegal or immoral or suggest that the consumption of alcohol will lead to social or sexual success;
    2. Contain any material which is defamatory or threatening;
    3. Contain any material which is obscene, offensive, hateful or inflammatory, or which promotes or incites violence or bigotry;
    4. Contain sexually explicit material;
    5. Harm or attempt to harm minors in any way;
    6. Be targeted at those under the age of 21;
    7. Feature anyone under the age of 25;
    8. Promote discrimination or prejudice based on race, sex, religion, nationality, disability, sexual orientation or age;
    9. Contain any sound recordings, logos, images, text or other materials which infringe any intellectual property rights of any person or any other third party rights;
    10. Be likely to harass, upset, embarrass alarm or annoy any other person;
    11. Be used to impersonate any person, or to misrepresent your identity or affiliation with any person;
    12. Violate anyone else’s rights, including their copyrights, trademark rights, or rights of privacy or publicity;
    If your Entry does include any of the above then it may be disqualified at the sole discretion of the Organiser.
  54. The requirements above only serve to provide examples and are not meant to be an exhaustive list of the types of unacceptable content that may result in the disqualification of your Entry. The Organiser reserves the right to disqualify from the Competition any Entry which it considers does not comply with these terms and conditions or which does not meet normal standards of taste and decency.
