Official Rules for US and Canadian Residents
There is no purchase necessary to enter.
1. Overview: This Contest is the North American portion of an international contest being offered by Bacardi Global Brands Limited (“Sponsor”) in various countries. These Official Rules only apply to entrants in the United States and Canada. Please note that it is possible that none of the winners will be from the United States or Canada.
2. Eligibility: The Contest is open only to (a) legal residents of the fifty (50) United States and the District of Columbia (except residents of Utah) who are at least twenty-one (21) years old and (b) legal residents of Canada (except residents of Quebec) who have reached the legal drinking age in their province/territory of residence. Employees of Sponsor or Tribeca Film Festival NYC, LLC, as well as the immediate family (spouse, parents, siblings, and children) and household members of those employees, are not eligible to enter. For residents of Canada, employees and contractors of the provincial liquor agencies, liquor licensees, their employees and members of their immediate families are not eligible.
3. Entry Requirements:

Sponsor will post an original script written by Geoffrey Fletcher for the Contest on the Websites (the “Script”). Your job is to interpret the Script in an imaginative and original manner. Your entry must consist of a written treatment of the Script written in English (no longer than 500 words) for a short film, no longer than five (5) minutes in length (the “Entry”). Entries which would result in a film longer than five (5) minutes may be disqualified, in Sponsor’s sole discretion. Entrants are NOT allowed to submit supporting materials such as videos, images or photographs and any entrants that submit supporting materials may be disqualified at the sole discretion of the Sponsor.

Your Entry must not: (i) be targeted to people under twenty (21) years old; (ii) feature people who are under twenty-five (25) years old; (iii) encourage, condone, promote, or glamorize under-age, excessive, or irresponsible consumption of alcohol products, drunk driving, or any behavior considered to anti-social, illegal, or immoral or suggest that the consumption of beverage alcohol will lead to social or sexual success; (iv) violate anyone else’s rights, including their copyrights, trademark rights, or rights of privacy or publicity; or (v) contain any defamatory statements or threats. In addition, if you are a US resident, your Entry must comply with the Code of Responsible Practices for Beverage Alcohol Advertising and Marketing of the Distilled Spirits Council of the United States, Inc.
4. How to Enter:

Visit imaginationseries.com or bombaysapphire.com (the “Websites”) and follow the instructions to fill out the entry form and submit your Entry. Sponsor reserves the right, in its sole discretion, to add additional websites/applications on which entrants can submit Entries. Only Entries submitted between 1:00 pm ET on April 29, 2013 and 7:59 pm ET on August 4, 2013 (the “Entry Period”) will be eligible. You may only submit one (1) Entry, regardless of which Website you use to enter.

By entering, you represent and warrant that: (i) you accept these Official Rules and Sponsor’s decisions regarding the Contest; (ii) your Entry is an original work that has not previously been published or displayed in any medium; (iii) you own all rights to the Entry.

Sponsor reserves the right to edit or reject any Entry that doesn’t comply with these Official Rules or that, in Sponsor’s sole discretion, is in bad taste. If any such action is taken during the voting period Sponsor reserves the right to reset the votes associated with the Entry to 0 or any other number, in its sole discretion.
5. Sponsor’s Rights to Entries: You do not transfer ownership of your Entry by entering the Contest. However, by entering, you: (a) irrevocably grant Sponsor, its agents, licensees, and assigns the unconditional and perpetual exclusive (or, in the case in which an exclusive license is not permitted to be granted electronically, non-exclusive) right and permission to copyright, reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Entry as-is or as-edited (with or without using your name) in any media throughout the world for any purpose, without limitation, and without additional review, compensation, or approval from you or any other party; (b) forever waive any rights of copyrights, trademark rights, privacy rights, and any other legal or moral rights that may preclude Sponsor’s use of your Entry, or require any further permission for Sponsor to use the Entry; and (c) agree not to instigate, support, maintain, or authorize any action, claim, or lawsuit against Sponsor on the grounds that any use of the Entry, or any derivative works, infringes any of your rights as creator of the Entry, including, without limitation, copyrights, trademark rights, and moral rights.
6. Winner Selection Process:

Short List: All Entries received from entrants across all countries during the Entry Period will be considered for short-listing by a panel of Judges based on the following Judging Criteria: (i) which Entry displayed the greatest degree of imagination; and (ii) originality in their interpretation of the Script. In the event Sponsor receives over fifty (50) Entries, a total of fifty (50) Entries will be shortlisted for consideration by the Judges. If your Entry is short-listed for submission to the Judges, you will be informed via e-mail on or around September 16, 2013. The odds of being short listed depend on the number and quality of entries.

Judges: A panel of Judges will review all entries on the Short List based on the Judging Criteria. The four (4) entrants with the highest scores shall be deemed the Judge Selected Finalists. The Judge Selected Finalists will be notified by email or telephone on or around October 13, 2013. In addition, the Judges shall select the five (5) entrants with the next highest scores to be included in a public vote (the “Voting Finalists”). The Voting Finalists will also be notified by email or telephone on or around October 13, 2013. In the event of a tie, the Judges will select the potential winner based on which tied Entry scored highest on Imagination.

Voting: The Sponsor or their third party representative will create promotional materials from and of the Voting Finalists (such as a mood board or treatment summation) (the “Promotion Materials”). The Promotion Materials will be made available through platform(s) from time to time as decided by the Sponsor (such platforms may include social media sites, Apps and websites), for individuals to read and view. Please visit the Websites for detail of where and how voting will happen once the Voting Finalists are made public. Between 8:00 am ET on October 14, 2013 and 7:59 pm ET on October 27, 2013 (“Voting Period”), Visitors to the voting platforms will be able to vote for their favorite Voting Finalists based on the Judging Criteria following the instructions posted on the voting platform (“Vote”). There is a limit of one (1) Vote per person per day and a person may only use one e-mail address to vote. Please see additional information about the voting process below. The Voting Finalist with the highest number of Votes shall be deemed a potential winner. In the event of a tie, the winner will be the entrant with the highest score from the Judges. The Winner from public voting (“Voting Winner”) will be announced by November 29, 2013. The Judge Selected Finalists and the Voting Winner will be considered the 5 potential winners.

Voting Process: You may not attempt to obtain Votes by any fraudulent or inappropriate means, including, without limitation, by: (i) circumventing (or encouraging others to circumvent) the Vote limits; (ii) using any automated system to Vote; or (iii) offering any inducements to others in exchange for votes; or (iv) using proxy voting schemes in which anyone other than the actual person submits the Vote. Sponsor, in its sole discretion, reserves the right to reject any Votes that Sponsor has reason to believe were obtained through fraudulent or inappropriate means.
7. Potential Winner Requirements: In order to win a prize, a potential winner may be required to complete and return the following documents: (a) a declaration of eligibility and release including, without limitation, the right to use their name, likeness, appearance, voice and biographical information for advertising and publicity purposes and agreement to take part in reasonable publicity and PR activities at Sponsor’s request; (b) a release assigning and transferring all rights, title, and interest in the Entry to Sponsor; and (c) in the case of a Canadian selected by public vote correctly answers a mathematical skill testing question without mechanical or other aid. If a potential winner fails to sign and return the documents within 7 business days of the date the documents are mailed, he/she will forfeit the prize and an alternate potential winner may be selected in his/her place according to the Judging Criteria.
8. Prizes: Five (5) winners will each receive the following:

Each winner’s Entry will be made into a short film of approximately five (5) minutes in length (the “Film”). All details of the Film shall be determined by Sponsor, in its sole discretion, and Sponsor shall have ultimate editorial, production, and creative control over the Film. Sponsor is under no obligation to distribute the Film or to incorporate any comments by potential winners into their Film.

Each winner will receive a trip for one (1) to attend a pre-production meeting and one (1) day of the Film shoot. The trip will be for a minimum of two (2) days. The dates of the trip and the destination city will be determined by Sponsor, in its sole discretion, and communicated to winners at a later date. The trip will include: (i) round-trip airfare from a major airport near the winner’s home to the destination city (if necessary); (ii) hotel accommodations for at least two (2) nights (double occupancy); (iii) ground transportation to/from the hotel and airport in the destination city; and (iv) three (3) meals per day.

Each winner will receive a trip for the winner and a guest (who must be at least 21) to New York to attend a premiere viewing of the film. The trip includes: (i) round-trip airfare from an airport near the winner’s home to the destination city (if necessary); (ii) hotel accommodations for three (3) nights; (iii) ground transportation to/from the hotel and airport in New York; (iv) tickets to attend the premiere event; and (v) $600 USD spending money.

The approximate retail value of each prize is USD/CDN $16,000. The actual value of the trip will vary depending on various factors, including the date of booking, the point of departure, and the dates of travel. If the winner lives reasonably close to the destination city, as determined by Sponsor, in its sole discretion, Sponsor may substitute ground transportation for air transportation. No difference between the approximate and actual value will be awarded. A winner is responsible for paying any applicable income taxes and any and all other costs and expenses not listed above. If any trip involves international travel, each winner will be responsible for obtaining any passports or other necessary travel documents. Any prize details not specified above will be determined by Sponsor, in its sole discretion. A prize may not be transferred and must be accepted as awarded. A winner may not request cash or a substitute prize; however, Sponsor reserves the right to substitute a prize with another prize of equal or greater value if the prize is not available for any reason, as determined by Sponsor, in its sole discretion.

Due to the nature of the prize and its connection to production of the winning Films, winners will be required to be flexible as to when they travel and have a valid passport with no impediment on entering the destination country. Sponsor will determine the dates, in its sole discretion, but they are likely to be between November 2013 and March 2014 for the production element of the prize, and the screening for the Film will likely take place in April 2014. Trips are subject to availability, blackout dates, and additional restrictions. The winner’s guest must be of legal drinking age in their jurisdiction of residence, and sign and return a liability and publicity release prior to issuance of travel documents. Once travel documents are issued, travel arrangements cannot be changed.
9. General Conditions: In the event the operation, security, or administration of the Contest is impaired in any way, Sponsor may, in its sole discretion, either: (a) suspend the Contest to address the impairment and then resume the Contest; or (b) award the prizes according to the Judging Criteria (with or without reference to the public votes) from among the Entries received up to the time of the impairment. Sponsor reserves the right, in its sole discretion, to disqualify and seek damages from any individual who tampers with the operation of the Contest, violates these Official Rules, or acts in a disruptive manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Sponsor by mail shall not be deemed proof of receipt. In the event of a dispute as to the owner of an Entry, the authorized account holder of the e-mail address used to enter will be deemed to be the owner. The Contest is subject to federal, state, provincial, and local laws and regulations and is void Utah, Quebec, and where prohibited.
10. Release and Limitation of Liability: By entering, you agree to release and hold Sponsor, Tribeca Film Festival NYC, LLC, Facebook, their respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) harmless from and against any and all liability, claims, actions, loss, harm, damage, injury, cost or expense (collectively, “Claims”) arising out of your participation in the Contest or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Contest (including the voting process); (b) technical errors; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Contest or the processing of Entries; or (f) injury or damage to persons or property. You further agree to indemnify, release, and hold the Released Parties harmless from any Claims that their use of your Entry (as contemplated herein) violates or infringes upon the rights of any third party.
11. Privacy and Publicity: Any information you submit as part of the Contest will be used for purposes of this Contest and treated in accordance with Sponsor’s Privacy Policy. If you have opted in, the Sponsor and its business partners may use your personal information to contact you for marketing purposes by email and/or SMS. The information you provide when you enter is provided to Sponsor, not to Facebook.
12. Disputes: Except where prohibited, you agree that any disputes, claims and causes of action arising out of, or connected with, the Contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Florida. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the laws of Florida, without giving effect to any choice of law or conflict of law rules (whether of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Florida.
13. Sponsor: The Contest is sponsored by Bacardi Global Brands Limited, 28 Dorset Square, London, England NW1 6QG. Tribeca Film Festival NYC, LLC, is not responsible for administering the Contest. The provincial liquor agencies are not connected with the Contest in any manner whatsoever, and are not liable in any way whatsoever in regarding to any matter which relates to the Contest. This Contest is in no way sponsored, endorsed or administered by, or associated with, Facebook. By entering, you acknowledge that Facebook bears no responsibility for this Contest and, to the maximum extent permitted by law, you release Facebook from any liability whatsoever in connection with this Contest. You understand that the information you provide is provided to the Sponsor (and its affiliates, associates and agents where applicable) and not to Facebook.
